On The Perfection Of Chinese Legal System Of Labor Dispatch

Since the 1990s, economic globalization had direct impact on the world economy development, also profoundly affected the political and social aspects of life. As one of the most important content in the social policy—labor relations is the most profound influence areas of globalization. Since China entered into WTO, the economic and social life in many aspects changed. This change is profound, comprehensive. This article introduces a important new employment mode (dispatchment), the origin and development of dispatchment. By analyzing some of the market economic countries and regions, especially some of countries which has advanced dispatchment legal systems, the author puts forward a useful suggestion on China's dispatchment legal system building from the views of protecting the labor force's right , promoting the employment and harmonious society in China by analyzing the cause of the disorder dispatchment..The thesis is composed of four chapters. The first chapter, the author introduces dispatchment and legal relation of dispatchment, according to the international labor organization of labor dispatchment definition and theoretical research situation, analyses the legal nature of labor dispatchment, and compares the labor dispatchment with vocational introductions, engineering contracting, business internal transfer. Then the second chapter, the author introduces the theory of labor dispatchment overseas study and practice, and focuses on the analysis of labor dispatchment standardize legislation international experience. Chapter three the author analyzes current labor dispatchment involving legal regulation and existing problems. From different aspects, the author firstly introduces the formation and development of labor dispatchment, and then expounds the current labor dispatchment involving legal regulation and the existing problems, including before and after labor contract law in our labor dispatchment problems existing in the system. Finally the fourth chapter the author talks about the idea of dispatch legal system strengthening, to establish the legislative idea establishment of the legal system of labor dispatchment , the basic principle of labor dispatchment , and according to the actual conditions of our country and foreign practice the author puts forward some policy suggestions on development model, developing steps, internal and external supervision.
