Our Lawyer Legal Aid Obligations And Its Performance Study

Legal aid is a legal system to support the poverty to participate in the legal process with no expense.The legal aid has developed from charitable period to national responsibility period. In charitable period, the lawyers had a moral duty to participate in the legal aid while they have a legal obligation in national responsible period. The lawyers had played a key role in it and made an important improvement to it.China's legal aid system has been upgraded on the path of institutionalized and standardized development since 1994. The promulgation and implementation of "Legal Aid Ordinance" of State Council in 2003 established the basic framework of China's legal aid system, and endowed the lawyers with legal obligation. The lawyers have a professional responsibility to provide the legal aid despite the nation has the national responsibility. The profession is not only a market role but also an important social role. It is an important part of the legal community and has the responsibility to protect the justice. Lawyers live depend on the law and for the law. It is the ethic character of the legal profession.The lawyers performed their obligation since 1994. They contribute so much to legal aid. We also face some problems in it, especially the inadequate of supply and low quality of the legal aid. Despite the ordinance regulates the lawyers to provide legal aid, their enthusiasm is not high considering the income and expense.We need to improve the private lawyer's aid, expand the government lawyer's aid and contract and project aid to develop the performing system. We need to build the quality control system to improve the private lawyer's aid. We need to expand the government lawyer's aid, especially the criminal legal aid. Otherwise, we can use the contract and project to perform the legal aid in the areas where lack of private and government lawyers.However, the nation has the main responsibility. The nation should devote the fund, professional person in legal aid and develop the legal system of it. It is the fundamental role of legal aid. It will build a foundation to improve lawyers to perform the obligation of legal aid.
