| Along with the progress of urbanization, private apartments replace the old style public apartment and become the main form of residential property in the urban area. As well known, condominium is an area where all other areas are mandatory except for the self-used apartment. The resident has exclusive ownership for the self-use part the building, and share the ownership of the common area and facilities with other residents. An important topic is how to maintain an effective control over the common areas and facilities of the condo, extend the use of the condo and ensure and enhance the value of the self-use part of the condo.The author starts this essay from the discussion of condominium and clarifies the definition of condominium by comparing the legislation of various countries on the names and concepts of the condominium. This essay further clarifies the object and nature of condominium and discusses, by case analysis, the limitations on the condominium owners when exercising condominium on the common areas. Furthermore, this essay explores the history of property management fees and analyzes the management of common areas with a view from the property right theory. At the end, this essay discusses relevant rules in Japan, France, Germany, the US, Taiwan and Hong Kong and raises certain proposals on the current management of condominium in China. |
