International Speculative Capital, Legal And Regulatory Research

Under the condition of modern open economy, unconfined flow of international capital unconfined flow plays a very positive role for resource allocation efficiency and economic growth, especially in economic and financial globalization, it becomes a important factor to push economic development in every country and the whole world. But in reality, international speculative capital which makes speculations in every country's market for high short-term profits by new scientific technology and financial products becomes a big threat to every country's economy. In view of this, how to lower the risk would be a very important problem for China. This article begins with analysis of international speculative capital, uses legal, economic and comparative analysis to the precautionary measures which the USA and some other developed countries and developing countries adopt. Considering China's situation and management experience, this article gives an answer to how to complete China's legal supervisory system. The innovation of this article is researching the supervision of international speculative capital from a legal point of view, emphasizing the importance of legal system. This article could be divided into five parts: The first part is a statement of the fundamental theory about international speculative capital. This part comparatively analyses the different concepts of international speculative capital, summarizes its history and features, investigates its advantages and disadvantages. The second part analyses the history of the supervision of international speculative capital. In this part, different types of the supervision of international speculative capital in different period are concluded to enlighten current system. The third part gives a statement to the national supervision of international speculative capital. Because developing countries and developed countries have different interests and economic level, different attitudes and supervision systems exist. The fourth part discusses international cooperation of the supervision of international speculative capital. This part analyses current situation of international cooperation and potential methods, finally gives suggestion. The last part discusses China's supervision system. This part elaborates international speculative capital's influence to China and the current situation of China's supervision, points out that China should make a reference to the developed countries' experience, and the key is to complete the basic legal system. In the end, according to China's economy, considering other developed countries' experience, this article gives the answer to how to improve China's legal system.
