The Research On The Legal Systems Of International Coordination And Cooperation Of Financial Supervision And Regulation Under The New Situation

This dissertation studies the legal systems of international coordination and cooperation of financial supervision and regulation under the new situation and the trend of international collaboration. First,the theoretic basis of financial supervision and regulation is discussed.the idea underpinning financial supervision and regulation is traced at an philosophic level.Of the early mainstream thinkings in Europe the philosophical source of financial supervision and regulation can be found.In China's Spring and Autumn Period the thought of the establishment of mechanisms for economic management founded by Guan Zhong and the enlightenment theory of Confucianism and Taoism,the contradiction theory of Marxist Philosophy provided historical origins and its demonstration of necessity for financial supervision and regulation. Then, the connotation, goals and ideas of financial supervision and regulation,as well as international coordination and cooperation of financial supervision and regulation and its related theories are discussed.The practice of globel and regional coordination and cooperation of financial supervision and regulation are also studied.Take Basel committee and EU for example,there is a analysis about their characteristics,significance and limitations.And gives a brief introduction of the general knowledge of the financial crisis,and a analysis about some problems on the idea,mechanism and international cooperation of financial supervision and regulation in some developed countries in this Subprime Mortgage Crisis.And it analyzes the future trend of the legal rules of international coordination and cooperation of financial supervision and regulation.The key part of this dissertation is the discussion on the legal mechanisms for international coordination and cooperation of financial supervision and regulation which are demonstrated based on two levels----the policy orientation and the Specific legal framework.The policy orientation involved as follows:to establish a new international unity Cooperation.to promoted international financial supervision and regulation based on balance between the national interests.to strengthen macro-prudential supervision.to carry out full supervision and regulation systematically to Strengthen the hard law, supplemented by "soft law".to adjust the regulatory framework and emphasize on internal control and industry self-regulation by financial sector.The legal construction of international coordination and cooperation of financial supervision and regulation concludes seven aspects.
