Aviation Equipment International Financial Leasing Legal System

Associated with the deep dependence of global economic development and sharp increase of passengers and cargoes flow, this thesis, Study on the Legal Framework of International Financial Leasing for Aircraft Equipments, aims at analyzing the legal problems in international financial leasing for aircraft equipments which is the most efficient method for the airlines to obtain aircraft equipments.Centering on the legal relationships in the practice of international financial leasing for aircraft equipments, this thesis explains the legal status of several trading parities and their rights and obligations by introducing the legal framework and the effects of Convention on International Interests in Mobile Equipment and Protocol on Matters specific to Aircraft Equipment, from one hand filling a domestic gap in the field of theoretical study on international financial leasing for aircraft equipments and from the other hand providing practical guidelines for Chinese parties who participate in the international financial leasing trades for aircraft equipments.Chapter One of this thesis first of all presents the history and development of international financial leasing for aircraft equipments for which Chapter One furthermore summarizes its characteristics and generally introduces the current legal framework. Chapter Two introduces the background, purposes, principles and applications of the newly adopted treaties, Convention on International Interests in Mobile Equipment and Protocol on Matters specific to Aircraft Equipment. Chapter Three and Chapter Four separately analyzes the legal problems of purchase relations and lease relations, and security relations in accordance with the domestic law of China and relating conventions. In view of positive influence of the new international registration system for aircraft equipments, Chapter Five focuses on the registration issues.
