Improvement Of Our Civil Aircraft Right Registration System From The Perspective Of International Interests Registration Under The Cape Town Convention

With the rapid development of the civil aviation industry,aircraft financing is in great demand for civil aviation enterprises.A wellestablished civil aircraft right registration system can not only protect the interests of aircraft financing creditors,but also enable civil aviation enterprises to obtain financing at a lower cost.However,China has not established a unified registration system for chattels' financing.High-value aircraft equipment cannot be registered in the Civil Aviation Authority and can only be registered as a general movable property.In the registration process,there are problems such as excessively dispersed registration authorities and lacking registration supporting measures.On the issue of registration of special movable property,the Civil Aviation Law and the Property Law conflicts with each other.Our civil aircraft right registration system cannot meet the demand of the current civil aircraft financing deals.Convention on International Interests in Mobile Equipment and Protocol on Specific Issues Concerning Aircraft Equipment are the latest legislative practices in the field of international aircraft financing,and via them an international interests registration system has been established.It is of great significance for improving our civil aircraft right registration system.However,it doesn't mean that we should completely follow their rules for there are also the problems that it cannot completely replace the conflict norms and lacks the protection of creditors.This paper analyzes the existing problems in our registration system,and put forward comprehensive measures by comparing the relevant provisions in the conventions above.In view of the condition of our civil aircraft financing activities,it is in urgent need to unify the registration authorities,establish an electronic registration system,expand the scope of right registration,establish the notice registration of the right of civil aircraft,and build an efficient civil aircraft right registration system.
