China's Non-legislative Administrative Norms And The Rule Of Law Research

Besides the administrative laws and regulations, there are lots of informally legal administrative standard documents concerning decisions and orders which are formulated by the administrative organs and have binding force. Due to the administrative demand of modern society, these documents have struck root in every aspect. They have been widely used by administrative organsto perform their administration and services functions, and have contributed a lot to the economic construction and social stability of China. They have exerted their unique function which cannot be replaced by other administrative means. But we cannot neglect their problems, which influence the image of the government and block the law process. It`s imminent for us to conform all other administrative regulations to proper standard.As a result, it` s necessary to have deep theorical study to draw a clear location and construction of infomally legal administrative standard documents and promote the law process. Based on the former study, the author will give the opinion of the basic theory and construction of these documents, and hopes to contribute to their development.
