The Plight Of The New Rural Socialist Concept Of Law Education And Countermeasures

In the context of new countryside,whether the socialist legal ideology education can be succeed is directly related to the fair implementation of the new countryside law,the process of rural legislation,and even related to the success or failure of the Chinese legal system construction.Socialist legal education can not ignore countryside reality and only can correctly choose the appropriate education policies through reality,seeking truth from facts and make clear the economic,political,cultural,and social and legal status.At present,our country's social democracy and legal system is going to be complete and perfect gradually;the new socialist countryside legal construction is also comprehensively launched,which has obvious achievement,however,the countryside socialist legal education is facing a series of predicaments due to the behind economic development and the farmers' weak legal sense.Choosing socialist legal education as the research object and taking the new rural construction as history background;making use of the basic principles and knowledge of Marxist jurisprudence;learning from the related domestic and international achievement of the rural legislation and socialist legislation,then combining with the practical new countryside situation to analyze in a systemized way.The first part mainly introduced the education theory of the socialist legislation: First,interpreted the related concept of the legal ideology and the connotation of the socialist legal ideology;second,briefly explained the background for announcing the education of the socialist legal ideology;at last,described the main content of the socialist legal ideology;the second part mainly are the analysis of the necessity and significance of socialist legal education.The necessity is that the socialist legal education is the must-choice for the new countryside legal construction,it can propel the modernization of the new countryside legal construction and make a good legal and cultural environment for the new countryside construction;and propel the new countryside all-aspects construction to let it develop continuously.The significance is that to construct the socialist new countryside we must stick to the five socialist ideologies firmly which are governing the country by law,law enforcement for people,fairness and justice,serve the overall interests and leadership of the Party;the third part introduced the predicaments and reasons of them for the new countryside socialist legal education.The manifestation of the predicament:first,the legal sense is weak and the lack of the legal ideology;second is the lagging legislation;third,powerless legal implementation and delaying legal aid;fourth,the insufficient legal education and low legal quality.The reasons for these difficulties are:Chinese traditional legal culture and conservative feudal thoughts,the rural local traditions and slowing and insufficient legal education;the legal ideology guidance ignored part of farmers' rights,interests and their capacity for acceptance;the defect of the legislation itself and hysteretic nature;the lagging economic development of countryside and lack the substance foundation for suing or handling cases further the lacking justice resources etc;the farmers selves' quality is low and the weak, behind legal education and publication in the rural area.The fourth part is the measures and strategies for the new countryside socialist legal education:first is to introduce the main principles for new countryside socialist legal education;second is to investigate the approaches of practicing it.
