On The Anti-trust Exemption System

The promulgation of Anti-Monopoly Law of the People's Republic of China contributes to promote the industry competition, optimize allocation of resources, protect consumer Benefits. However, it is unreasonable to be focus on industry competition while neglecting industry protection. Some scholars believe that the negative influence of anti-monopoly law is the reason why the anti-monopoly law exemption system exists.In the perspective of industry exemption, the article outlines the characteristics, ideal candidate, base of law, economics and politics of the anti-monopoly law exemption system. By compare of the industry exemption system of developed countries, the article uses a comparative study of methods to research the present situation of our industry exemption system and its theoretical basis with chinese characteristics. The industry exemption system of China shows our industrial policy, industrial ownership structure, government control, state-owned assets and fiscal policies. Furthermore, the article puts forward a sound proposal of our anti-monopoly law exemption system in two ways of procedures and entities, on the basis of revealing the abuse of industry exemption and the development trends of other countries'anti-monopoly law exemption system.
