Research On Legislation And Protection Of Copyright Of Written Works Under Network Environment

This article mainly studies current situations of written works copyright protection legislation and judicature in China under network environment with the research purpose of finding out some existing problems in copyright management system,legislative protection and judicature under network environment in China at present,using relevant experience of other countries for reference,and coming up with corresponding suggestions for perfections of copyright management system as well as legislative and judicial protections under network environment in China.This article mainly adopts document research and case analysis methods as its research techniques.By means of some researches on documents,it uses advanced experience of other countries that are proved to be feasible after verifications;By virtue of case analysis researches,it finds out existing problems of copyright management and protection in legislation and judicature at present and then comes up with specific and targeted suggestions.The main contents of this article include relevant researches carried out on characteristics of written works copyright under network environment,characteristics of copyright infringement acts,current situations of infringement as well as current situations and existing problems of legislation to find out some existing problems in legislation.Through researches on the above contents,this article draws conclusions that copyright protection legislation under network environment is not thorough and rigorous enough,that current legislative system lacks integral and systematic mechanisms,and that some problems also exist in judicial jurisdiction.Through researches on the above problems,this article comes up with innovative suggestions from angles of collective management of copyright,perfections of copyright legislative contents and judicial jurisdiction of copyright.On the whole,this article starts with current situations of legislation,case and management system of copyright protection in China through researches on domestic and overseas documents,analyzes problems facing juridical protection of copyright at present,thinks deeply about problems,and comes up with creative and innovative solutions.
