Research On Copyright Infringement Of User-created Content

The rapid development of the network and network communication technology has made the copyright issue in cyberspace more complicated.Since the Internet technology was upgraded to Web 2.0,the Internet has developed into an age of interactive search and social.The network platform is no longer an information publisher.The network users are no longer just recipients of information.The Internet platform provides network users with Information upload space,network users have become publishers of information.This kind of content created by the network users in the network platform space is User-created Content,or UCC for short.UCC may constitute network works.A work in the sense of copyright law should be protected by copyright.Therefore,it should prevent the copyright of UCC works from being infringed.At the same time,it is necessary to avoid copyrights infringement of others when creating UCC works.Particularly,as the UCC model has been widely adopted and used by various types of network media,the number of users participating in the Internet has continuously increased.The copyright issue of UCC works increasingly demands research and treat seriously.The full text includes the introduction and the conclusion,which is divided into six chapters.The first chapter,introduces the UCC copyright infringement to be studied through introducing the background of this research,as well as the results achieved by the Institute,and based on the study of the relevant literature,further analysis of the research methods required for this topic.And expectations of innovation.The second chapter,analyzes the necessity of UCC copyright protection.First of all,due to the emergence of UCC,the creation of UCC works triggered the UCC copyright issue,and then put forward the requirements of preventing copyright infringement and protecting the copyright of UCC works.Second,UCC works constitute works in the sense of copyright law,and copyright protection should be given.Ultimately,UCC needs to protect the copyright of UCC works.The third chapter,to protect the copyright of UCC works,to prevent UCC works from being infringed.Based on the definition of infringement of UCC works,this paper discusses the main infringements of copyright in UCC works,the subjects of infringement and the infringers.The fourth chapter,authoring UCC works should also avoid infringing the copyright of others' works.This paper discusses the infringement of UCC's creation of infringing works,the subject of infringement and its role and relationship in infringement.The fifth chapter,puts forward that in the light of the principle of balanced benefit governance,from the aspects of the improvement of legislation and judicial measures as well as the improvement of UCC platform,the direction of future legal improvement is clear,which helps to solve the problem of UCC copyright infringement.The sixth chapter is conclusion.The regulation of UCC copyright issues requires special legislation to balance the interests of UCC platform operators,network users and copyright owners,so as to create a good network copyright environment.
