Rational Legal Culture In Contemporary China Construction And The Rule Of Law Process

With the tremendous social changes caused by China's modernization objective and market economy orientation, it is an irreversible trend for China's march into a society based on law. However, as a product of human civilization, legal system can trace its origin to the West. It is a system long developed and nurtured from Western culture against its unique societal and historic background. And Chinese traditional legal culture is a typical product from agrarian society. Its basic characteristic is the combination and infiltration of etiquette and law. The concept of ruling by etiquette is the centre of Chinese traditional culture. It is fundamentally different from Western culture. Due to the lacking of spiritual foundation required for the development of legal system in Chinese culture, the establishment of Chinese legal governance business must start from the construction of a sensible legal culture. And the birth of a sensible legal culture is the pre-requisite and warranty for the construction of a law-govern society. Only when the popular mass develops faith in law and a sense of whole-hearted recognition and belonging in the existence of law then a society ruled by law can be surfaced.
