Ship Repair Legal Research

This thesis discusses about the legal problem in ship-repair. The ship we discusses here is beyond the definition which the ((Maritime Law)) made. Based on the ship repair contract, the topic focus on the potential legal disputes, this thesis illustrate the legal relationship in ship repair, and contrapose the topic discussed in this thesis, the writer made the very suggestions in the end.Chapter One illustrate some definitions and conventions talk in this thesis, and clearly redefine the exclusive words such as Ship, make a brief introduction of Standard Ship-repair Contract, which is one of the work contract and service contract. Chapter Two and Three illustrate the subject and object of contract, and the right and obligation the contract set. Chapter Four illustrate how to solve the problem in ship-repair, mainly focus on litigation and arbitration. Chapter Five illustrate the rem of ship inter alia possessory lien and maritime lien, mainly focus on the priority level between possessory lien and maritime lien. Chapter Six illustrate the potential risk and fraud in ship arrest if the ship-repairer want to request the court to detain the ship. Chapter Seven make a summari2e from Chapter before, based on analysis of the problem laid in the process of ship-repair, the writer make his own suggestions on correlative law, contract and rules in ship-repair company, in accordance with the problems mentioned before.Based on a lot of cases, the thesis analyse the problem laid in the practice of ship-repair, after illustrate the legal relationship in the ship-repair contract under Chinese Law System. This thesis contribute on the injury in the ship-repair project, the priority between possessory lien and maritime lien, the risk in incorrectly ship arrest and the fraud in ship-repair contract.
