China's Food Recall The Perfection Of The Legal System

States to the people first, people with food-oriented, food, as security first. Food recall legal system, the prevention of food safety incidents has played an important role. In 2009 China's new"Food Safety Law" proclaimed the China's food recall system in the establishment of the legal level, which means food recall system in China has entered a new stage. In this paper, the basic theory of food recall paper analyzes the concept of food recall system, content and theoretical basis, in-depth understanding of the practical significance of food recall. Through the United States, Australia and Canada's legal system for food recall to recall the type of recall levels, recall procedures, the contents of the study, summed up the advanced experience, and from the content of such legislation and legislative level, a comparative analysis of China's food recall status of the legal system and found that China's food recall system, although the late start, but the recall level, recall the type and so provides a more detailed, with international practice. However, China's food recall legal system in the regulatory system, food traceability systems, food inspection system, food safety, information disclosure system and so there is still room for improvement.Thus, proceeding from reality and context of the current legal system of China's food recall in the implementation of the difficulties that exist, such as legal system is not sound behind the food inspection system, monitoring system and chaos. In order to improve the food recall system should adhere to the basic principles of a starting point, draw on advanced international experience in developed foreign countries, and select the appropriate mode of China's legislature. Finally, to present my modest measures to improve the food recall, we can improve our legal system and food traceability system, set up food recall liability insurance system and the introduction of punitive damages mechanism and the establishment of strict regulatory system, clearly the position of the government enterprises in recall and so on.
