In recent years, with high speed development of economy and transforming of the society, the group dispute and group action assume the unceasing rise in our country. But in our country, deputy action system have some defects.This paper is at basic of reviewing types of the group litigation system in foreign countries,include American, England and Japan, combining with the condition and reality in our country, puts forward some opinions of the reformation and modification of the group litigation system in China, to wish that can have some help for modify our group litigation system.To provide and lay a solid foundation to later research, the first chapter carried on a more systematic discussion to the basic theory of group action. In this chapter, the author firstly carried on the limits the broad sense and the narrow sense of concept of group action and analyzed the characteristics of group action. Finally, the author analyzed the value and function of group action.The second chapter the author analyzed and compared theory and practice of group action system in representative countries to put forward a model plan to the construction of group action system of our country. In this part,the author introduced and compared American opt-out class action as representative, English and Sweden opt-in class action as representative.The third chapter has mainly analyzed the present situation and defects of the representative lawsuit in our country.The last chapter, the author proposed overall thought of group action system reform in our country. We can improve the representative lawsuit in our country and put forward to the opt-out class action.
