Growth Mechanism Of China's Legal Modernization

The modernization of law is one part of the development of modernization. The trend of the world modernization has become many countries common pursuit .I think that legal system modernization is a ievitable process, and shows regularity. During the step of legal system constrction, the modernnization of legal system's significance is that: it can make lots of fields pay close attention to themselvs , not only in the aspect of subjective, but aslo many new question that raised by new times. So , it can reflects and interprets relations of life , which helps us understanding the means of the new times'spirits clearly. However, for us, the first task is, what its means for us, at least, we must understand the meaning in some aspect. Only on this basic, we can gasp the condition of understanding our questions an answers. One of the modernnization of legal system is that, it can helps us close to our realities, and can help us find out some feasible methods.The understanding of the characteristics of modernization of legal system will help us plan a blueprint for its furture, also help us understand correctly influense beteew the modernization of China's legal system and globalization. In line with the basic theority of Marxism , when we think of this process dialectically, I think that it should include two aspects at least : firstly , during the process of unification , the individual has abandoned its own specific in order to achieve the universality. Secondly, individual-specific renouces the heteropoly heterogeneity, so as to achieve the purpose of resumption of their own.Above all, on this basic, the authorhopes to get helps from two concepts: the logic of practice and the logic of idea, one hand takes the mordern legal system's universal facts, one hand takes the modern legal system in China's performance reason and tend during that process. Highlighting China legal system's construction is the result of historiy necessity, at the same time , trying to find its new tend on the basic of analysis of human rights and policical rights.
