China's current maritime law enforcement system is the product of planned economy. Although experienced in 1998 and 2003 institutional reform, maritime law enforcement system is still unable to get rid of "full government control". Maritime law enforcement system is still a traditional decentralized management system. This industry sector institutional arrangements and division of work-based model lead to uniform maritime law enforcement powers by different departmental separation, to some extent intensified law enforcement costs, reduction in enforcement efficiency, also lead to blame-war power, the law enforcement responsibilities are not clear legal consequences. At the same time, it also runs counter to the reform concept of "General Departments". With the "control of marine, development oceans" has become the consensus of the world, the world's more than 100 countries have been actively promoting maritime law enforcement system, the successful formation of the Coast Guard to effectively protect its maritime rights and interests. How will the effective implementation of our maritime homeland defense, maritime security, maritime security, maritime traffic management, marine resources and environmental protection?This paper studies the theory and maritime law enforcement advanced experience of foreign maritime law enforcement, based on analysis of the status of maritime law enforcement system and the problems, explores ways to optimize maritime law enforcement reform, put forward the idea of set up the China coast guard.
