On The Issue Of Reunification Of The Administrative Procedures Legislation

To establish a government administration based on the rule of law is an important part of the rule of law, and administrative rule of law is one of the most important indicators of the Chief of the main legal basis for the exercise of powers in the procedure. The rule of law and improve the country or region, usually has an excellent administrative procedural law. Since reform and opening up administrative and legal system in promoting the rule of law and administrative procedures, a lot of work has been done in China. We have achieved some success, but there are still many problems. Administrative procedure legislation unbalanced and uncoordinated is a very prominent problem. With the administration to further promote the rule of law, the administration has become the key issues constraining the rule of law. How to take effective measures to solve the unification of administrative procedures legislation, in promoting the rule of law and government construction is of great significance.This paper studies the domestic and foreign administrative procedure legislation document sorting and classification, combined with the development of the administrative procedure legislation, a comprehensive analysis of the rule of law and our administrative procedures, administrative procedures, decentralized nature of legislation as the merits and the main problems, and from many of the administrative procedures of the unified legislation for further proof, trying to benefit from international experience in the effective basis, combined with China's administrative procedures extent the feasibility of harmonization of legislation, on how to develop in line with our national conditions of the Administrative Procedure Act propose assumptions and suggestions.
