Research On Legal Liability And Insurance Relief Of School Sports Injury Accident

With the rapid development of the economy and society, sports gradually go into the masses. With the support of national policy in recent years, campus sports become an important pillar of the mass sports in our country. But in the meanwhile with the school sports activities flourished, sports injury accidents often happen, causing the dispute also grow with each passing day. The emergence of the campus PE injury accidents not only brings serious effect to students and their families, but also to the school management inconvenience and great challenge.The value orientation of law changes constantly along with the progress of the society, from individualism to social standard, to take into account changes in individual standard and social standard. Along with the change of the legal value orientation, principles of law also have new development and changes. The imputation principle also changes constantly in order to adapting to the value orientation of the law society. The author takes campus sports injury accident compensation as the research object, analyzes litigation case, combs the relevant legal system, and investigates the imputation principle and the system construct of personal tort liability. This paper analyzes the current situation of sports insurance of primary and middle schools in Nanjing, compares the present situation of campus sports insurance at home and abroad, puts forward opinions on how to balance the development of campus sports and construct reasonable insurance mechanism.Besides introduction and conclusion, this paper consists of three parts. The first part:"reorganization of the liability of compensation for the campus PE injury accidents", the main responsibility for compensation for the campus PE injury accidents identified comprehensively expounded, from the nature of the liability, the campus tort liability elements of campus tort, imputation principle and applicable scope and standards of compensation and other aspects, analyzes the legal laws and regulations the damage compensation relating to campus PE injury accidents, theories and judicial practical.The second part:"school sports insurance responsibility", and six primary schools six schools selected from Nanjing city four city conducted a questionnaire survey, understanding and analysis of the current Nanjing City elementary and middle schools sports insurance development present situation, the parents of the students cognition of sports insurance and the student sports injury risk anticipation etc.The third part:" Proposals on the development of Nanjing elementary and Middle Schools Sports Insurance", at home and abroad, the campus sports insurance development present situation to carry on the comparative analysis, from the perfect school sports risk management point of view, put forward to revise and perfect the sports insurance system suggestion.
