Under the background of the globalization of economy and trade, the communication, understanding and cooperation in international cultural and educational fields is ubiquitous. Along with the trend, the development of the internationalization of higher education becomes more flourishing. Meanwhile, the education for overseas students plays an important role in the internationalization of higher education, so almost every country is taking positive measures on drawing a lot of overseas students in order to meet the need of national economic, political and cultural interest. The amount of overseas students in China is rising with the improvement of its comprehensive national strength, therefore, how to ensure the educational quality has become a key issue.Australia, a "big educational export country", has turned into a relatively perfect system on the management of overseas students' education. The Government endeavors to let overseas students in Australia have a safe, enjoyable and rewarding place to study. Then Education Services for Overseas Students (ESOS) legislations are enacted to promote quality education and consumer protection for overseas students.By elaborating on the enaction, enforcement, result and evaluation of Australian ESOS legislations, this thesis aims to put forward some constructive suggestions. Firstly, the writer trims the history and status quo about Australian education for overseas students. Secondly, the structure and the main contents of the ESOS legislations are expatiated. Then the writer chose the execution of Queensland University of Technology as a case study. Finally, after the evaluation the revelation from the Australian ESOS legislations are presented in order to hasten the legal construction of overseas students in China.The thesis falls into four chapters. The first chapter introduces the history and the status quo of Australian education for overseas students which provides the background of ESOS legislations and helps to understand the structure and the main contents of the law better.The second chapter puts the structure and the main contents of the ESOS legislations into the scope of research. By examining each phase through Education Services for Overseas Students (Registration of Providers and Financial Regulation) Act 1991, Education Services for Overseas Students Act 2000 and the ESOS legislations system, the thesis observes each cause, structure and content, and character to hold all-around. The third chapter is a case study on the enforcement of Queensland University of Technology. By studying the enforcement of ESOS legislations in Queensland University of Technology, the thesis furthers the exploration of ESOS legislations.The fourth chapter makes a panoramic review on the legislation of Australian education services for overseas students, and suggests that there is much to be done to improve legal system on overseas students in China. On the basis of the research on Australia, the thesis brings forward suggestions, such as by transforming the traditional conception of the education of overseas students in China as the first step.China is attaching more and more importance to its overseas students nowadays; however, the research on legal construction is underway. The original intention of the thesis is to provide the revelation to legal construction of the education of overseas students in China.
