The operational risk (OR) is one of main risks which the banking faces but has long been neglects for the people. In recent years it has caused international finical institutions serious losses and attracted great attention in the banking world. As a periodic achievement in guard against the OR, the Basel New Accord (Basel II) brings the risk within its orbit for the first time after defined "operational risk" and promotes supervision and regulation(S&R) of the OR.Domestically, the OR becomes "principal root" of the trouble which Chinese banking industry had confronted with, and high proportion management level cheat which results from unfavorable external circumstances, deficiencies in S&R and poor internal control, especially biased economical legislation, dislocation idea of S&R and too bad OR management has had the serious negative influenceThe article inspected the regulation rules of OR which proclaimed by Basel committee's of Bank Supervision, compared the operational-risk-based capital supervision, and appraised its influence. Introduced US' development in S&R of OR, compared with the Sino American banking interior audit, has analyzed regulation rules, the supervision duty, the work routine, the method that the federation agencies rely on and forecast its reform measure. And then, the article inspected Hong Kong banking industry's S&R of OR, conclude that the key succeeds factor is occupational ethics, manager's responsibly in internal control and constantly law reform based on Capital Adequacy Ratio.Finally, the article inspected and appraising Chinese banking S&R of OR from perspective of legations practice, then put forward the suggestion that we should be try our best to reform the government S&R, improving internal control ,enhance to information transparency.
