The important purpose to implement Agreement on Technical Barrier to Trade (TBT) under World Trade Organization is to prevent fraud and protect intellectual property. Since China's entry into World Trade Organization, there have been many concerns on China's intellectual property protection which is becoming a hot issue in international society and WTO disputes. In this essay, Agreement on TBT, Agreement on Trade-related Aspects of Intellectual Property Rights (TRIPS) and the Convention on Biological Diversity (CBD) are described in details. What is more, conflicts and coordination of these three agreements in the perspective of intellectual property are well discussed. Combined with Biological Diversity Agreement, the relationship between TBT Agreement and TRIPS is emphasized in this essay. Intellectual property protection is well studied in the view of TBT. At last, ways of using international agreements concerning TBT, especially rules of WTO, are recommended in order to effectively protect intellectual property and interest of our country.
