In today's society, with the rapid development of information communication technology, Internet technology, the field of trade related intellectual property rights has been rapidly widen, the following intellectual property problem namely the Agreement on Trade-Related Aspects of Intellectual Property Right, plays a very important role in WTO, it together with services trade and trade in goods constitute the three pillars of the WTO. Protection of intellectual property in knowledge economy era is worth pressing concern. Through the research, we found that the protection of intellectual property rights, both the international and the domestic, has been focused on deeply, countries have introduced the national intellectual property strategy, implement intellectual property rights protection as a national strategy.In this paper, I introduce the intellectual property rights definition, characteristics, function, and the legislation and rationality of protection of intellectual property rights in international and domestic, the reasons, characteristics and implementation methods of protection intellectual property rights barriers, on the basis of the research of other scholars, and analyses and summarizes the intellectual property of the influence on China's trade barriers, finally, puts forward some strategies in China.Based on the process of writing, this paper use the theoretical analysis combined with examples confirm; use the Interest analyze method, to analyze that the causes behind the interests of intellectual property rights, and the forming and development of intellectual property rights are the results of interests consideration and design, and the benefit to compromise, the nature of intellectual property rights need to be recognized by interest analysis; use the method of empirical analysis, through a lot of data, diagrams to analyze China and world intellectual property barriers. The possible innovation in this paper is theory combined with practice, much more empirical analysis, very intuitive, and then forms my own view.
