From joining the World Trade Organization in2001to surpassing the United States to become the world’s first largest trading country in2012, China’s import and export trade has made great achievements. However, the pressure has never been reduced, but increased.In order to solve the severe affection to China’s export trade because of lack of competitiveness of products and frequently encountering intellectual property barriers, we must strengthen the protection of intellectual property rights, so as to improve the knowledge and technology in foods, and enhance their competitiveness, reduce property disputes. However, there will also be some negative factors exist, such as rising corporate and social costs, weakening the competitiveness of exports.This brings a few questions, first, in the face of the double impact from strengthening intellectual property protection, the Chinese government and enterprises should how to deal with? At the same time, how to exchange adverse factors to favorable factors, so as to promote China’s export trade? Second, how to measure and quantify the level of intellectual property protection in China, in order to meet the requirements of timeliness, rationality and practicality? Third, considering active and negative impact, whether we should strengthen the protection of intellectual property rights? What kind of impact will strengthen the protection of intellectual property rights bring to the increase in the trade volume of China’s exports and export trade structure improvements? And to what extent?To solve these problems, this paper first departure from the theoretical study of intellectual property protection of the positive and negative impact on China’s export trade, and try to discuss its adverse impact from three aspects of legislation, law enforcement, and reducing the cost, and how we respond to it? Second, we selected eight indicators from five areas meeting the timeliness, rationality, practicality requirement to measure the current level of protection of intellectual property rights in China, and as a basis for empirical study of the level of intellectual property protection on the export trade scale, the study finds that between the level of intellectual property protection in China and export trade exists long-term equilibrium relationship, export trade has a significant positive effect on intellectual property protection, strengthening the protection of intellectual property rights will promote China’s export trade. To further explore the role of intellectual property protection play in improving the structure of China’s export trade, the paper selects six variables including the level of intellectual property protection affecting the export trade, and establishes a multiple linear regression model of different industries. The results find that the export of knowledge-intensive industries is more sensitive than labor-intensive industries in the response to the level of intellectual property protection. Raising the level of intellectual property protection is conducive to the improvement of the trade structure.
