On The Issue Researching Of Legislation System Of China's Enviromental Laws

With the enhancement of our economy, the progress of the society as well as the advancing of idelogical understanding, environmental issues are increasingly underlined by governmental bodies and the masses. And environmental legislation has been experienced a procedure from scarcity to existence, from establishment to betterment, from principled regulation to specification.Since 30 years' reform and opening up, through exploring and learning, our country preliminarily established a system of environmental law characterized by Socialism with Chinese characteristics. Guided by the constitution, embracing laws, administrative regulations sector regulations, local and governmental regulations, as well as international environmental law as the main contents, which plays a crucial role in environmental protection of China.However, when we see our achievements, we should be keenly aware of the shortcomings of our environmental law system. For instance, current environmental laws are lauched by Standing Committee of the National People's Congress, the State Coucil as well as local legislative bodies, and they are not heightened to national basic laws. Besides, the specific provisions of environmental protection employ a strong streak of administration and overemphasize the supervision role of administrative organization but ignore the participation of the masses.So far, the constitution has not yet granted the right to environment to citizens. Futhermore, the procedural law in our country has not stipulated the public-service litigation system. The existence of these problems renders the gap between the environmental laws of our country and those of developed ones. Environmental issues are strategic and play an important role in economic development and the advancing of comprehensive national power. Hence, we must highlight theestablishement and perfection of environmental law system.Based on the previous research results and referring to relevant laws and regulations, this thesis objectively analyazes the status of the legislation of China's environmental laws, probes into achievements and shortcomings of the legislation of China's environmental laws, makes some proposals to the perfection of environmental law system of Socialism with Chinese character.
