China is a huge agricultural country, where have a variety of natural resources, natural ecosystems, mainly locate in rural areas. The rural areas is not only the birthplace of natural resource, simultaneously is also the weak zone of Ecological Construction. The environmental rights and interests of rural areas and farmers must get substantial attention from various circles of society. The current environmental protection of rural areas should focus on lets the rural residents drink the clean water, breathe to the fresh air, and eat the unworried health food; therefore, we must focus on the comprehensive treatment of rural water environment, especially the integrated prevention of rural water pollution. In view of legal means meet with great difficulties on rural prevention and control of water pollution, this paper mainly base on analyzing current situation of rural prevention and control of water pollution. Among many causes point out the significant impact of lack of legal provisions on rural prevention and control of water pollution, including inadequate laws and regulations, no laws to abide by, low legislation level, and new Law of the People's Republic of China on Prevention and Control of Water Pollution still unresolved a number of issues, etc. At the same time there is such a timely analysis of the causes of many short-board laws. Backward in environmental legislation and the difference between rural and urban are external causes, but also legislator takes no count of rural water pollution prevention and control and rural environmental awareness is not intense enough are the internal causes. Otherwise, this paper analyzed the legal research situation and legislation practice of rural water pollution prevention and control in United States, Japan, South Korea, EU and other developed countries. The referable experiences has been summarized, such as the establishment of the concept of sustainable ecological and environmental protection, the announcement of flexible policy of rural water pollution prevention and control, the expanding government functions and the establishment for legal systems of action by the environment. Furthermore, from five aspects, such as legislation, law enforcement, judicial, environmental awareness training and strengthen legal supervision, to investigate how to improve the system of rural water pollution prevention and control on the legal stage.
