Since the reform and opening in China, with the rapid development of economy, the problem of rural environment pollution has been increasingly prominent. The problem of pollution has seriously affected the new rural construction of China, and hampered the coordinative development among economy, society and environment in rural areas of Shanxi province. So protection rural environmental from pollution is urgent affairs currently in the new countryside construction, which is also the urgent demands of well-off society construction. Therefore, according to the particular conditions of the rural environmental pollution and deficiency of laws of environment protection, it is important to strengthen legislation of rural environment pollution prevention.In this paper, basis on existing research, from the perspective of monocracy, we analysis the problem of rural environment pollution and put forward a series of constructive suggestions. Firstly, the author expounds some related concepts and theories about rural environment pollution prevention, and based on the conditions of rural environmental pollution, we reveals the source of rural environment pollution. Then, in view of existing problems of the rule of law, we indicate the deficiency of rural environmental legislation, enforcement, judicial, law-abiding, and profoundly give some advices about how to improve and strengthen the institutional arrangements; lastly, we also adopt the strengths of law of rural environmental, and enrich the construction of rural environmental law. We expect to forward an arrangement for administering the rural environment, and construct a new socialist countryside that is legal maturity and environment friendly.
