As an important means of coordinating economic development and environmental protection, the emission rights trading has been highly valued by all the countries in the world. The experimental practice of the emission rights trading system has been taken in partial regions. This thesis is aimed to explore the feasibility of the Chinese emission rights trading system through the analysis of the relevant aspects involved in the emission rights trading system, the current situation of the American emission rights trading, and the difficulties and obstacles of practicing the emission rights trading in the Chinese model regions. The legal and economic theories have been applied to analyze the current problems of the Chinese emission rights trading system. Furthermore, some proposals on establishing the Chinese emission rights trading system have been made, which may be helpful in the implement of this system.The thesis is started with the basic conception and relevant theories of the emission rights trading. It is followed by the discussion of the current situation of the Chinese emission rights trading and the problems in model regions. The discussion is concluded that it is feasible to establish the Chinese emission rights trading system. The introduction of the American emission rights trading serves as a reference to the Chinese case. Thus, the legislative proposals concerning the Chinese case have been made in the last chapter. Besides the introduction and conclusion, the thesis consists of four parts:The first part is conducted to prove the rationality of the emission rights trading system in theory. The definition, property, effect, and significance of the emission rights trading system have been explored in this chapter. The relevant theoretical basis of this system is mentioned, such as the scarce resources theory, the externality theory, and the Coase theory.The second part is concerned with the current situation and existing problems of the Chinese emission rights trading. In order to control the environment pollution and resource waste, the local government has made active exploration and carried out the emissions rights trading in model regions. Jiangsu pattern and Jiaxing pattern are emphasized in this part. Therefore, the feasibility of the Chinese emissions rights trading system is demonstrated.In the third part, the current situation of the emissions rights trading in the United States is described. It is in America that the emissions rights trading system is first applied to control the environment pollution. Thanks to this system, the environment quality is improved and the cost of improving environment is reduced. The analysis of the advantages and disadvantages of the American emissions rights trading system sheds light on its establishment in our country.The fourth part is targeted to make legislative proposals for establishing a sound emission rights trading system in China. The proposals include four aspects:confirming the legal emission rights, establishing the emission total amount control system scientifically and reasonably, constructing the just and efficient initial emission rights distribution system, formulating and improving the emission rights trading supervision system.
