Discussino On Public Participation In Environmental Inpact Assessment System

High speed development of the economy, in addition to greatly improve the people's standard of living, has brought unimaginable environmental pollution and ecological damage. Emergence of eight pollution-world environment, make people aware of the threats to the survival of the human race has, people come to realize the importance of protecting the environment. Since the third plenary session, rapid economic development, has made great achievements in economic construction at the same time, environmental pollution in China is also becoming increasingly serious. There are many reasons leading to this,mostly because of China's current system of environmental protection are not sound enough, in particular, public participation in environmental impact assessment system is inadequate and led to a lag of environmental protection on the one hand, and reduced the enthusiasm of the public participation in environmental protection. In this sense, the study of public participation in environmental impact assessment system has its necessity and inevitability. Public participation in environmental impact assessment system to play an important role, through the legislative practice of States in the world, have proved to be a very effective measures to protect the environment, public participation in environmental impact assessment of legislative determination, has become the world's main development direction of environmental protection laws.State administration of environmental protection act of2006, of the interim measures for public participation in environmental impact assessment was China's first specification for public participation in environmental impact assessment documentation, this greatly promoted the development of public participation in environmental impact assessment. But because of public participation in environmental impact assessment of a late start in China, compared with the practice of foreign legislation there are still many deficiencies. This article hopes to foreign legislation comparison practice and domestic legislation, from abroad, public participation in environmental impact assessment system of the State of the art of legislative practice, and specific national conditions of China's, views and solutions. This article is divided into five parts, respectively, to basic concepts of public participation in environmental impact assessment, public participation in environmental impact assessment of abroad development situation, national survey of public participation in development and there is not enough for elaboration and analysis, analysis on this basis, looking for solutions.
