| In the" law of the people's Republic of China river traffic safety management regulations" promulgated in 2002, further defined the maritime department's function on salvage of wracks. However, due to the lack of a clear legal basis for compulsory salvage and effectively solve the salvage expenses problem, when the wreck were refused to salvage or been delayed, it was difficult for salvage departments to implement compulsory wreck removal operations, thus many sunken ships have serious impact on traffic safety. According to the requirements of new public management law, the government in the public administrative management should only make policy rather than take the implementation of policy, namely the government should put the management and operation separately. According to this theory, this assignment has classified the relevant legal norms, defined the maritime department's responsibility in the salvage process, and analyzed the duties of parties in the process of compulsory salvage. Based on investigations of Jiangsu province inland waters salvage situation, the author has investigated the actual situation of Jiangsu inland water wreck salvage, compared the functions before and after administration of the contrast transfer, focusing on the occurrence of several problems after the transfer, referred advanced practice of other provinces and related reference books. Finally this article has, from the perspectives of existing law, discussed the suitable river salvage management mechanism, to explore an effective management mechanism, to solve the problems in reality to provide some constructive suggestions. |
