Lack And Construction Of Humanistic Spirit In Chinese Contemporary Rule Of Law

Reform and opening up have more than thirty years. We have got achievements in China's theory of the rule of law, the legal system construction and so on. But there have been many of the problems to be solved in the process, studying the root causes of these problems, we have found that the crux lies in lacking the humanistic spirit of the contemporary of rule of law.The purpose of the rule of law is the protection of human rights, while the implementation of the law and the rule of law can not realize without the action of the main body, so the inherent requirement of the rule of law determines the rule of law in all starting from the people, people-oriented, to human values, freedom, dignity , happiness and overall development as an ultimate concern. In the third plenum of the party put forward a "people-oriented " concept of development, which pointed out the direction of rule of law in our country, but due to the lack of human spirit of the cultural soil, there is no reason for the rule of law such as the formation of beliefs, a serious impediment to China's"People-oriented"concept of the rule of law in the rule of law in the full and active role.
