Research On The Trust Of Emissions Trading

In recent years, the environmental pollution, the Earth warm effect became the topic which the world citizen paid attention generally; At the same time, in December,2009 the Copenhagen summit, pushes the environment question to the time wave crest. Therefore, the research on the carbon emissions which take the market regulation as the foundation, complies with the world environmental protection trend of development tidal current and has a great guiding sense in the practices of the humanity.The carbon emissions do as one kind of special accurate real right, has the property right nature. Therefore, the carbon emissions as an authoritative property had decided the possibility of that it becomes the object of the trust legal relationship. Through the comparison research with the Japanese carbon emissions system, unifies the problems that existent in our country, proved that the trust of emissions trading in our country feasibility, the necessity and the system superiority; At the same time, refers to the trust practice experience of the Japanese carbon emissions. Through discussing the carbon emissions structure and obligations content in the trust legal relationship, proposed some suggestions from four aspects to construct our country carbon platoon system. First, the establishment of the system of the trust necessary law laws and regulations on the carbon emissions; Second, the design of the carbon emissions tax revenue system; Third, the construction of the trust benefit certificate on the carbon emissions; Fourth, the establishment of the trust registration system on the carbon emissions.
