Analysis On Global Aviation Carbon Trading Mechanism

In the global context of reducing carbon emissions,the aviation industry is duty-bound to do the corresponding emission reduction work.Establishing a global carbon trading mechanism is the best way to reduce emissions in the aviation industry.The construction of aviation carbon emission trading mechanism should follow the theory of law.At the same time,it should fully follow the principle of common but differentiated responsibilities and balance the interests of the environment and economic to maximize both interests.In the legal relationship of aviation carbon emissions trading,the legal nature of the object aviation carbon emission rights is the contention between property rights and regulatory rights.It should be more reasonable to quantify the regulatory rights.The global aviation carbon emissions trading mechanism is still in early exploration,not only the corresponding laws and regulations are not perfect to make the law inadequate support,but also exist problems such as international cooperation that lack the support of multilateral mechanisms.Considering the problems in the current mechanism construction and drawing lessons from the experience of the major countries and regions' aviation carbon emissions trading practices,the proposal should start with a carbon offset plan proposed by ICAO and gradually transition to a global aviation carbon trading mechanism in stages,While promoting the cooperation among countries with the soft law advantage,the relevant international legislation should be perfected to provide legal support for the construction of the mechanism.At the same time comparing the national aviation carbon emissions trading system to arrive at the most suitable basic system such as a reasonable carbon emission quota allocation plan,a reasonable price control mechanism,a sound performance guarantee mechanism and link mechanism with other carbon trading systems.
