The Study On Controlling Countermeasures Of Education System Duty Crime

In recent years, the education system has become one of the hit areas of duty crime. The Education system once was a"non-gravy department", now are invaded and attacked by the increasingly corruption. Education system should be the main field of imparting knowledge and educating people, who is in charge of the great mission to cultivate the builder and successor of socialist society. Therefore, the corruption of education can be named as the most serious way of corruption, which is much more harmful than any other industry or social department's corruption. It not only seriously violates the economic interests of our country, tramples the image of gardeners who are the example of virtue and sacrifice, but also damage the education environment of ideological and political, which brings terrible negative effect on students. For this reason, the school surroundings and atmosphere of cultivating society's futures and state's pillar is facing a huge challenge. Therefore, it admits of no delay to control the duty crime of education system. To administer the duty crime of education system, it requests to stick to the policy of simultaneously combining the mode of blocking and scanty, prevention and punishment. When resolutely punishing the duty criminal, it's also needed to pay more attention to the basic effect of prevention and construction of double track mode of"prevention—attack".In this paper, it consists of three sections excepting the introduction and the summary.The first section summarizes the duty crime in education system. It reveals the concept of education system duty crime on the basis of understanding the definition of duty crime and comparing it with the key component of other duty crime. The so-called education system duty crime, refers to some one who enjoys a certain power in the education system or other personnel with the convenience of position, abuse his power or illegitimately perform his function and power to do something to be harmful to the school administration order, the national interests and social interests, which should be punished according to China's present criminal law. Furthermore, it analyses the classification, current situation and harmfulness of this kind of crime based on its concept.The second part is about the feature and ways of investigation of education system duty crime. It's the important part in this paper. First of all, the section gives a statement about the feature of education system duty crime. Then on the basis of this statement, it comes into a discussion about the ways of investigation of education system duty crime. Education system duty crime has the features such as crime subjects are relatively concentrative, they collude with each other, gang up to commit crimes, and tend to be well educated, high position, and the criminal behaviors become centralized links, various ways, long period and frequency, etc. Secondly, starting with the features of education system duty crime, it structures the investigation plan and strategy which adjusts to the education system duty crime.Investigation plan generally includes three parts of content, which are the analysis of details of case, choice of investigated methods and breach, establishment of investigation plan. It's the premise and accordance of the whole investigation works, which play the role of wind vane of continuous depth investigation; Investigation strategy means during the process of investigating the crime, to expose, discover and verify the crime, and then to discover and seize the suspect, the investigation organ and its personnel have to develop their subjective initiative according the actual situation to design scheme and strategy of outwit, fineness. Therefore, they must insist on the law of cognition that there is contradiction between universality and particularity. It requires them to grasp the particularity through universality while to summarize the universality from particularity.The third section of this paper can be divided into two parts, the causes of education system duty crime and its prevention and control countermeasures. At the beginning of this section, it analyzes the deep-seated causes of current serious situation of the education system duty crime, including the imperfect laws and regulations, corrupt of ideology and vacancy of education, the lag behind of the management system and structure, relatively concentrated power, lack of effective supervision, inadequate punishment of crimes, etc. In the basis of the causes, it analyzes in-depth of the prevention and control countermeasures according the case to prevent and control the education system duty crime from the aspects of legislation, education, system and supervision.
