Research On Cyber Drug Crime And Prevention And Control Countermeasures

Since the 1980 s,drug crimes have resurfaced in our country and have begun to spread,becoming one of the main types of crime in our society.In recent years,with the popularity of Internet technology,criminals have used the Internet as a tool and platform for drug crimes,making cyber drug crime a new form of drug crime.This paper collected 298 cases of cyber drug crimes in China in the past 11 years from 2006 to 2017(the first-instance judgment),summing up the characteristics of cyber drug crime in China and the causes of crimes,and proposed corresponding prevention and control.Countermeasures against cyber drug crimes.This article is divided into five parts:The first part mainly introduces the research background of network drug crime and its research purpose and significance,and briefly expounds the criminological research methods used in this paper,namely literature research method,case analysis method and empirical research method.Provide a general discussion of the premise and overview for the following.The second part mainly defines the research object of this paper,through the analysis of the concepts of "drugs","drug crimes" and "cyber drug crimes" and the specific five types of crimes involved in China's "cyber drug crimes",define the concept of network drug crime and clarify the scope of the research object,laying the foundation for the accuracy of the later analysis.The third part collects 298 cybercrime criminal judgments(first-instance judgments)issued by the People's Court from 2006 to 2017 through Peking University's Fabao(http://www.pkulaw.cn/),and extracts relevant information.On the basis of reorganization,the paper summarizes the current situation of the number of crimes,the geographical distribution of crimes,the crimes involved,the types of drugs involved,the characteristics of criminal means,criminal space and criminal subjects,and strives to be more comprehensive and accurate.To understand the cyber drug crimes and to ensure the pertinence and effectiveness of criminal countermeasures.The content of the fourth part is a summary of the causes of crime.This article follows the mainstream criminological research ideas,including the psychological incentives,social management factors,criminal investigation factors and cultural factors that stimulate the generation and development of online drug crimes.It aims to comprehensively construct a multi-level network drug crime cause system.The fifth part is based on the empirical analysis of the phenomenon and causes of cybercrime crimes in the first four parts.It proposes the countermeasures for cyber drug crimes in a targeted way,mainly from weakening psychological incentives,strengthening social management and strengthening law enforcement investigation.
