The modern theory of administrative benefit is in the tradition based the theory of executive pay, along with the modern development of the concept of democracy and human rights. It's an important role to protect civil rights on livelihood issues. China is in a critical period of social development and solve the livelihood problems of social development in order to lay a solid foundation, thus improving our system becomes more urgent.Thesis bases on the division of administrative benefit for survival and development of the payment of benefits in two stages. It bases on the administrative rights of payment and not locates in the beneficiary on the basis of survival. Try to build a payment system in line with our national conditions by studying. That maximizes the protection of civil rights and can realize the constraints on public power. Procedures system is the key to achieve a sound balance. Therefore, building system to improve the procedures is the central link.Paper is divided into four parts. The first part is the basic theory of executive payment, including the concepts, characteristics, types and theories. The article is discussed from the broad definition of executive payment. Rational division of the payment type is the foundation of improving the system. The second part discusses the typical of foreign national administrative payment system, mainly Britain, Germany, and Sweden. The biggest advantage is that the British system institutionalized level is high and has integrity protection mechanism; the German system is characterized by more emphasis on the role of society, a high degree of socialization; the system of Sweden safeguards widely, high level of benefits; these experiences are worth learning. The third part details the shortcomings of our system of legislation and lack of practice, including unified payment standards, low benefit levels, insufficient funds, a narrow range of payment objects, the lack of the necessary oversight mechanisms. The fourth part is the specific idea of improving the system: improving administrative system must adhere to the principle of payment: the principle of combining survival and development, the rule of law, the principle of proportionality, trust protection principle and the principle of fairness; establish a multi-level payment standard; on the financial security, expand the channels of fund-raising and improve the level of social protection; by providing for summary procedure and the general procedures to ensure not only to protect civil rights but to achieve the main role of supervision of administrative body; in the relief system, improve the administrative litigation payment and expand the range of administrative litigation.
