Improvement Of Administrative Payment System

Administrative benefit, as an important means for the government to protect basic civil survival by using public power, has become increasingly important in the modern society. It is not only to protect citizens enjoy basic living conditions, provide conditions and possibility for people's survival and development, but also to regulate and control the economy, alleviate social contradictions, and promote the harmonious development of society. In this paper, we have started with the concept of the administrative benefit, point out the legal characteristics of it, define the connotation of China's administrative benefit, discuss the legal basis of administrative benefit, including the protection of human rights theory, the theory of state responsibility, and administrative services theory and the theory of fairness and justice, and then detailed analysis the legal relationship of administrative benefit, point out the subject, object and content. Then, I have introduced the framework of our country's existing system of administrative benefit, pointed out the main problems of China's existing system of administrative benefit. By investigating the development of administrative benefit system in major Western developed countries with comparative analysis, I have summed up their own characteristics and reference for China's situation. On this basis, the paper has put forward a number of proposals to improve the system of administrative benefit in our country from the external environment and internal mechanism, it has considered that if we want to improve the system of administrative benefit in our country, we must first optimize the external environment, including the establishment of public administration, strengthen government integrated administrative benefit capacity, and improve the social security system, strengthen the interaction of intermediary organizations, advocacy services executive and the concept of the protection of human rights , then perfect the system from the scope of the administrative benefits, standards, funding, systems, procedures, standardized system of internal supervision mechanism and relief respect.
