Research On The Prevention System Of The Accident Of Injured Students In The Compulsory Education Phase

With the steady development of China to be under the rule of law and with the perfection and popularization of the laws of education and the civil law, citizens of China have come to be aware of the concept of equality and the rights of their own. They are paying more attention to life, health and human rights. The frequent tort cases happening in schools have aroused the concern in society, which to some degree reflects the process and achievement of the construction of China to be a country under the rule of law. The theoretical and practical progress of the tort cases of schools concerning the protection and the dealing with them is closely related to that of the construction of China to be a country under the rule of law.In spite of this, due to the late start of the establishment of China to be a country under the rule of law and the low level of education into law system, there is still a lack of laws, when tort cases of schools arise, to clearly define the relationship among schools, families, the state and society and clarify the relevant legal duty and responsibility of one another, causing the compensation and further investigation of the cases to be nonstandard, unscientific and fruitless, which is extremely unfavorable to the prevention of the tort cases and the protection the of legal rights of the primary school students and middle school students in their compulsory education phase. The tort cases of schools frequently reported in newspapers have led to heated discussions in society. The cases have done great harm not only to the students themselves, but to their families and society. Therefore, how to prevent such cases happening in primary schools and middle schools has become a very important issue which society, parents and schools are all concerned about.Thus, whether from practical angle or academic angle, it is pressing and essential to perfect the prevention system of tort cases happening to the students in their compulsory education phase.This paper starts with the basic definition of tort cases of schools and then after analyzing the present situation of the prevention system concerning tort cases happening to students in their compulsory education phase, the writer found some defects and disadvantages. Based on this, strategies are offered as to how to perfect the system to prevent the happening of tort cases of students in their compulsory education phase so that the writer hopes to make a little contribution to the prevention and dealing with the tort cases.
