Media Supervision On Jurisdiction

The relations between the judiciary and media is a most important and most sensitive issue during the process of socialist legalization, also means between the principle of judicial independence, including justice independence, and the public supervision, which based on media supervision most of the time. The traditional dispute still remains, which shows all the phases of defer on both side of this conflict, as far as deep consideration in theory and practice. But every coin has tow sides. Justice independence and media supervision are constant friction on one hand, can help each other forward on the other hand. Media supervision will strike the principle of judicial independence, especially justice independence, when ecumenical judicial justice. Justice independence requires a relatively close space without outside intervention. So it will naturally walking away from media supervision. It becomes a necessary meditation on the actual to find settlement of conflict of rights, such as the demarcation of rights. The Supreme People's Court issues a judicial interpretation about rules of media supervision on justice practice. It means that the People's Court willing to open and accept the oversight of the news media. It also provides valuable content for future legislation of the press law of China.The paper starts with several real cases. I employ comparative analytic approach, simple analysis, and dialectical method, discussing the conflict of judiciary and media, trying to find final settlement. I analyze media supervision on justice practice by narrating the real supervision of traditional media and network media. Though analyze the particular judicial interpretation, noting the importance of media supervision. The last chapter goes over the settlement of conflict of rights. Hope they tow making concerted efforts to advance the present socialist legal construction.
