The Research On China's Accessory Legislations And Supervisery Mechanism

The accessory legislations guarantee the effective law enforcement meanwhile play an important role in the legal system which embraces socialism with Chinese characteristics. The enactment situations of accessory legislations matter significantly with enforcement of higher‐level law and the construction of a socialist country under the rule of law.The Author would not be unrealistically optimistic after finishing the positive analysis on enactment situation of accessory legislations both on central organizations and provincial locality organizations due to the common situations of the lower compeleterate and lengthy period of enactment, the frequent divergence of the appointed framer, the lower legal hierarchy and so on.The relevance between the disorder of accessory legislations and the lack of supervisory mechanism is obvious. Generally speaking, China lack systemic supervisory mechanism though the law enforcement inspection, the validating mechanism, the report for reference mechanism and thematic survey do their job in some level.In the future, the transmission of the idea among parent law framers, subject of supervision, accessory legislation framers should be materialized. Secondly, the legislative techniques and monitor routine should be improved. The last but not the least, the punishment aiming on inaction of accessory legislations, both politically and legally, is a viable measure.
