| Logistics is rising rapidly in recent years, its rapid development brings to convenient life builds Bridges between regional economic transactions, also contributes strength to the prosperity of international trade. But this industry has just begun to developed, it still not being very mature. Because of its not slandered practice operations and no special regulations on this aspect, the parties of Logistics usually had disputes due to their rights and obligations during the practice work. For this kind of disputes, judicial organs could only refer to Contract Law and other relevant sectors on the basis of specific condition ns to make judgment. Under this kind of circumstance, this article would discuss the present development situation of Third-party Logistics and its development direction and what kind of support should law provide. The point the author tried to emphasize is that the legal position the Third-party is in and the legal responsibility the Third-party undertakes during the logistic practice. On the basis of above statement, the author will give some suggestion to improve the predicament that logistic parties are confronted with.The article could be divided into four parts. The first part introduces the present development situation and the concept and character of the Third-party logistics. Then the part also states the legal position of the Third-party and the legal nature of the logistic contract. The second part states the legal responsibilities the Third-party undertake responsibility period, imputation principle and limitation of responsibility in the logistic relationships. The third part discusses the legal risk the Third-party confronted with on the basis of the previous two parts. The last part of the article analyses the legal environment the Third-party faced with, and then the author propose some legal advice and political suggestions to help the government offer an better environment for Third-party logistics. At last, the author hope that our national logistic industry could be more developed with the improvement of legal system and policy. |
