The Legal Regulation Of Social Responsibility Of Transnational Corporations In Perspective Of International Law

On the background of ecomoic globalization, beacouse of the inherent character of Transnation Corporation that the ultimate goal of these companies is great number of economic interest.And this character of Transnation Corporation promot the development of international economic and improve people's welfare to which country its operation, but also bring a series of social problems, such as the labor rights violations, damaging the environment, etc. Thus the problem Of Transnation Corporation social responsibility trigger the focus of the society. The international community, including international organizations, non-governmental organizations, and civil organizations, began trying to develop some of the provisions or mechanisms to regulate the social responsibility of transnational corporations effectly. In addition, multinational companies are also developing a voluntary model code of conduct to regulate their own behavior. An international level of social responsibility of transnational corporations system of international law has taken shape. With the social economic development and research in-depth the social responsibility of transnational corporations system of international law continuous improvement. But becouse of the international community on the problem of how to regulate the social responsibility of transnational corporations is still in stage of constant exploration,and a t present, the rules on social responsibility of transnational corporations is still has many deficiencies.So based on the context of global economic integration, from the perspective of international law, through the elaboration of theory of corporate social responsibility and the current system of social responsibility of Transnation Corporation, this paper attempts to explore a social responsibility of transnational corporations more effective way to monitor.The first part of the article is mainly on the basic theory of social responsibility of transnational corporations. First of all, introduced the definition and characteristics of multinational corporations and outlined the impact of transnational corporations in global. Second, at the international level, the requirements of international community should regulate social responsibility of transnational corporations are growing louder. At the same time,the power of transnational corporations in developing countries is rise. These factors makes it become an urgent requirement to regulate the social responsibility of transnational corporations in international lawsThe third part of the article is major collate and analysis the existing international legal regulation of transnational system. By introduct and evaluat the content and nature of some representative rules. In order to make us have a more clear understanding on social responsibility of multinational of international law system. And then point out the difficulties of implement these international. An idea proposed which is develop a unified international law on social responsibility of transnational corporations. Also pointed out that in the uniform norms of international law when the transition has not been established. We should strengthening the international soft law and transnational corporations legislation of the home country effectively regulate the behavior of multinational corporations.The fourth part of the article is Contact to the actual of our social responsibility of MNCs in China and related laws and regulations. Then make recommendations on Norms of social responsibility of transnational corporations legislation.First of all, Elaborate the status of Social responsibility of transnational corporations in China and the status of the legal regulation of Social responsibility of transnational corporations in China. Then on the basis of this given some suggestions on the legal construction of corporate social responsibility. First, China should strengthen the communication between China and the international community.Actively participate in the international community to regulate transnational corporations of social responsibility by law-making. Second, strengthening our mad-related legal system from all aspects of legal formulation, implementation and supervision. Third,we should actively communicate with the multinational companies in China. In exploring our regulation of corporate social responsibility mechanisms, strengthening the cooperation with multinational companies in China.The fourth,face to many international soft law on social responsibility regulation of transnational corporations, we should learn from it boldly. That meet specific conditions of China wo should actively accept and implement.
