Legislative Proposal On The Crime For Media Judgment

The media supervision and the judicial independence are the two basis elements in the modern society. Media is called "crownless king" in the modern countries; it plays a vital part to the whole society. At the moment, the media begin to improve its effort in the supervision on the judicatory, the conflict between the media and the judicatory become more serious. However, we can find some common grounds between the media and the judicatory. The media supervision is in favor for the judicatory in some way, and the judicatory fair needs the media supervision, so in my opinion, it is necessary that the media supervises the judicatory. But we should know that the media supervision will be damage the fair of judicatory, if the media supervision can't work in a limitation.This paper content three captures. The thesis tries to introduce the media and its character; thesis also tries to introduce the judicatory and its character. The media is a tool for transmission and a tool for democracy. And the judicatory is a tool for realizing the fair of society. The characters of media are reporting news immediately and freedom, but the characters of judicatory need a independence environment. This makes the conflict between them. However, in any way, the media supervision is a necessary for the modern countries. And then, I try my best to analyze the influence of the media supervision to the judicatory, especially the negative effects. In the second capture, the thesis introduces "media judgment" which is the negative effect of the extravagant media supervision. The "media judgment" gives the influence through "emotional judicatory", and they are different. The "media judgment" is an obstacle to the good relation between the media and the judicatory. In last capture, thesis just introduces how to prevent form the "media judgment". Thesis gives two ways to do this thing. One is that we may build some principles for the media supervision; the other is building a crime and punishment to prevent from the "media judgment".
