Talk About Consummating The Externally Overseeing And Restricting Mechanism In Our Police Enforcement

All people that have the power are easily to abuse "This is Montesquieu's famous quote, As an important national security administration and criminal justice power, police have extensive power. In order to ensure that police powers within the statutory range, we must strengthen supervision and constraints. This two are integrable and inseparable. Compare to the internal supervision's "self supervision", the external supervision has particular significance because of its variety subjects, extensive means and hlighting externalities . After decades of development, external supervision and constraints of police enforcement has formed with its own characteristics, and it has played an important role in the prevention of the power abuse and improvement of the law enforcement efficiency .But there are still shortcomings, such as, external supervision and constraints Mechanism has not become systematic, the overall function is not strong, lacking of cooperable effort, Emphasizing supervision after the events, neglecting post-supervision and preventive monitoring , public supervision of police are superficial. lacking of availability and so on. The result is that supervision and constrains are not strong enough in reality, law enforcement issues frequently happen. This requires to improve the external supervision and constrain machine of the police, and to build comprehensive supervision net. We do this not only to prevent and correct improper behavior in police law enforcement also and people's legitimate rights and interests, but also led the police to better administration and law enforcement.This thesis can be divided into three parts. The first part explain the common theory of external supervision and constrain of the police law enforcement. The connotation of external supervision and constrain is defined firstly, then refer it's features and necessity. Further analysis its theoretic basis : politics and sociology models. Foreshadowing for the following discussion .The second part mainly discusses the Status of the external supervision and constrain of the police law enforcement, detailing the main form of external supervision, and pointing out the problems. The third part is the key part, it discusses how to improve external supervision and constrain mechanisms, specifically including five respects :improve power supervisory and constrain mechanisms, and improve the democratic supervision and constrain mechanism, strengthen the coordination of the body, combining internal and external supervision and constrain, emphasizing the continuity of the supervision, improve the supervision to supervisors.
