On The Chinese Government Information Publicity Legal System

April 5, 2007, the state council of the People's Republic of China promulgated the Regulations on Disclosure of Government Information (hereinafter referred to as the Regulation), and on May 1st, 2008 officially implemented. This is the first national government information publicity legislation in our country, the position of the Regulation is self-evident in the disclosure of government information system construction process, it marks the democratic political construction of significant progress, it is helpful for the transformation of governmental functions and it is the guarantee of citizen's political rights, but this does not mean that our government information openness system is consummation, our country government information openness system still need to be further perfected. According to the Regulations, this article analyses the problems and the reasons of current information openness system construction in China, and attempts to point out solution.This paper is divided into four parts. The first part is as the breakthrough point, through the ministry of health 2008 to 2010, the disclosure of government information system construction situation, and with the comb form of data analysis, through the form of some actual examples to explain our government information openness system in the implementation of the regulations in China, points out the problems of the government information openness system after the enforcement of the regulation, shows that the information openness system need further perfection. The second part of government information publicly outlined, expounds the meaning of the government information and the publicity of government information, and analyzes the different concepts of government information publicity, public affairs, administrative openness and e-government, and analyzes three legal basis of the government information openness system - theory of people's sovereignty, right to know, the rule of law thoughts. The third part introduces the beginning of our government information openness system, with some local regulations of government public information has been promulgated in 2003, the construction of the information openness system into a rapid development age, it shows the process of government information openness system in our country. Based on the content of the Relations, points out the present problems of government information openness system in our country: Relations itself did not make clear a regulation right to know, the principle and scope of public information is not clear, Relations rates low, the Regulations and the Secrecy Law, the Archives Law there are conflicts, the Commercial Secret Law and Personal Privacy Protection Law vacancy, supervision and relief system is not perfected etc. The fourth part through to the domestic and foreign some advanced experience of reference, puts forward the countermeasures of government information openness system, including: enacted the government information publicity law, establish and perfect the disclosure of government information and relevant law, perfect the publicity of government information, supervision and relief system, etc.
