A Study Of China's Construction Of The Underground Water Right Trading System

The exploitation of the underground water has long history in our country, and from the time immemorial, there have been cases of"Digging well for drinking"and"Digging well for irrigation". The rational utilization of the underground water resources has played an important role in the sustained and rapid development of the economy and society. At present, the underground water shortage has been the primary factor that hinders the social and economic development of our country. In many areas of our country, there is severe excessive exploitation of the underground water resources and the contradiction of supply and demand is increasingly intensified. We are confronted with the pressing task of the efficient utilization and optimal allocation of the underground water resources. It couldn't meet the demand of our socialist economic development to distribute and administrate the underground water resources only through the administrative means. The solution to this lies in the establishment of the underground water trading market and the implementation of the underground water trading system and the reasons are as follows. Economically, the trading system can divert the water resources from low economic area to high economic area through the redistribution of the water resources. Environmentally, the trading system can provide a"pressure release"system of the water for environment as the household can obtain water through this system and they won't make unauthorized use of the water for environment. Besides, the trading system enables the holder of the underground water right to sell the water yield saved through the improved water use efficiency and this can enhance people's enthusiasm for saving water.Under the guidance of the sustainable development outlook, this thesis adopts the method of combining the theory with practice and consists of four parts. In the first part, this thesis clarified the concept of the underground water right and gives an overview of the underground water right trading. In the second part, this thesis analyzed the feasibility and necessity of constructing the underground water trading system. In the third part, this thesis takes America and Australia as an example and gives an analysis of the underground water right trading in foreign countries. The last chapter is a proposal for the construction of the underground water trading system in our country based on the analysis. The proposal includes the following aspects: to implement the initial distribution of the underground water right; to establish the underground water trading market; to construct the underground water trading system; to perfect the relevant laws and regulations of the underground water right trading. It is hoped that the establishment of the underground water trading system can be beneficial in the following aspects. First of all, it can improve the underground water utilization ratio and alleviate the severe situation of the underground water utilization in our country. Besides, it can promote the reform of the water right system and water resources administrative system in our country and strengthen the exploitation, utilization and protection of the underground water resources. Furthermore, it can bring into play the economic measures in the optimal allocation of the underground water resources and realize the construction of the water resources market mechanism with Chinese characteristics. Finally, it can realize the sustainable exploitation and utilization of the underground water resources and promote the sustainable development of the economy, society and environment.
