To solve this problem, we must carry out legal reform, improve the water rights trading market legal system.This article, first, starting from the analysis of water resources allocation mechanism proposed that the market is the inevitable choice of the allocation of water resources. To the foundation for the construction of water rights trading market, we have to clearly define the concept of tradable water rights referred to in the market in the allocation of water resources, and define the relationship between government and market. Secondly, by drawing on foreign legal system of water rights transactions and analyzes our country existing water right system in China, points out the problems need to be solved in our country’s water right trading market construction. Finally, based on the analysis of the basic problems in the water rights trading market, combined with the reality that our country’s water right trading is still in the initial stage, we think that the water right market should be in the government’s comprehensive management and then put forward some suggestions for constructing the Water right trading market legal system.
