Legislative Scheme Of Agricultural Insurance In China

Agriculture is the foundation for economic development. Without the development of agriculture, national economy can't develop healthily and rapidly. However, agriculture is always the weak industry in China, with a vast rural population and little agricul tural resources per capita, and low income for farmers on average. Agriculture, as an industry with high risk, is susceptible to natural disaster, economic policy and market demand. In order to keep rapid and constant development for agriculture and stabilize the society, agricultural insurance has obtained rapid advancement and relevant laws in agricultural insurance has taken shape and got significant effect with the execution of agricultural insurance in some countries, In China, agricultural insurance is still new. Just because the agriculture plays an important role in the national economy, it is necessary to perfect our agricultural insurance law. That's why the author writes this thesis.This paper introduces the history of our agricultural insurance based on historical and authentic analysis, and sums all kinds of factors which restrict the development of agricultural insurance. These factors include the miss of agricultural insurance law that make the problems occur in the agricultural insurance unguarded and serious insufficiency of government subsidy on agricultural insurance. Through comparative analysis, the author draws foreign experience from overseas agricultural insurance laws and'puts forward own propositions to institute our agricultural insurance law, such as legitimate principles and purposes and any other concrete terms with government's support and subsidy, risk share system and scope and supervision of agricultural insurance as examples. All these provisions are operative. The innovative points in this paper contain introduction of basic theories of agricultural insurance law, generalization of legislative status quo, research on feasibility and necessity of legislation and some advice on how to make our agricultural insurance law more perfect. This paper aims to sum principles and objectives of agricultural insurance law from other experts and propose suggestions on the execution of agricultural insurance law, meanwhile, and to constitute some kind legal system which is conductive to our agricultural insurance development.
