On The Impact Of China’s Accession Into WTO On Its Agricultural Insurance Legislation

The effects of China’s accession into WTO have been increasingly appeared.This year is not only the twelfth year of China’s accession into the WTO, but also thefirst year for its Agricultural Insurance Regulation to come into effect.Agricultural Insurance Regulation has stipulated many aspects of agriculturalinsurance, such as the agencies, the ways of organization’s promotion, the fundsraising and the mechanism for diffusing the risk of huge catastrophes. Although it hasprovided basic legal guarantee for the development of China’s agricultural insurance,this is just the beginning of the legislation. There is so much space for futureimprovement, especially the connection of WTO rules and the domestic legal system.As one of the main policies of agricultural domestic support under the WTO rules,agricultural insurance in the other WTO members has been confirmed throughlegislation. This provided China some beneficial experience. After joining the WTO,China has speed up the building of the agricultural insurance legal system, but there isstill a big gap between the domestic agricultural insurance legislation and the WTOrules. In the future, it is necessary for China to grasp the extensive and far-reachingeffects of China’s accession to the WTO. And moreover, China should realized thenecessity and urgency of developing agricultural insurance as a new measure ofdomestic support, take advantage of the building-up of solid economic foundation, theincrease of political will to legislate and the enrichment of the basis of agriculturalinsurance legislation, and implement the ideas of efficiency, fairness, opening-up andsecurity to press forward with legislation to maintain stability of China’s agriculturalinsurance. To get a thorough understanding of the new opportunities and challenges isthe prerequisite and foundation of China’s agricultural insurance legislation. Only inthis way, can China’s agricultural insurance legislation keep pace with the times andmove to a better place.
